You Are The Product

Terms of Use

Last updated: 24 March 2024

1. Acceptance of these terms

By accessing or using You Are The Product (the “Service”), you agree to be bound by these Terms of Use, our Privacy Policy and any supplemental notices posted within the Service. If you are acting on behalf of an organisation, you represent that you are authorised to bind that organisation and all references to “you” include that entity. If you disagree with any part of these Terms, you must discontinue use immediately.

2. Description of the service

The Service is an interactive attention-economy calculator that models the revenue generated by time spent on popular applications and platforms. It is intended for educational, research, journalistic and exploratory use. The material is provided “as is,” with no guarantee that the insights are suited to commercial planning, compliance filings or investment decisions.

3. Definitions

For the purposes of these Terms:

4. Eligibility and acceptable use

The Service is accessible without creating an account and can be used by individuals aged 16 and older. You agree not to misuse the Service, including by introducing malicious code, deploying automated scraping tools, copying datasets at scale without attribution, circumventing technical safeguards or interfering with other users’ access. We may suspend or block access if we believe your use violates these Terms or threatens the stability of the Service.

5. Licence and intellectual property

The Service and its Content are owned or licensed by us and protected under UK and international intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable licence to access and use the Service for personal or internal business analysis. You may not reproduce, modify, distribute, publicly display, reverse engineer or create derivative works based on the Content without prior written consent, except as otherwise permitted by law.

6. Inputs, outputs and attribution

Calculations run entirely in your browser; Inputs are neither stored nor transmitted to a server. By supplying Inputs you warrant that you have the right to use the information and that it does not contain sensitive personal data about others. You may cite or export Outputs in your work provided you attribute “You Are The Product” and do not misrepresent the methodology or suggest endorsement.

7. Data accuracy and assumptions

We periodically update underlying datasets using public filings, industry research and vetted benchmarks. Nevertheless, the Outputs remain estimates subject to change. Actual monetisation rates vary by region, audience mix, product changes and macroeconomic factors. We disclaim any obligation to update the Service on a specific cadence and any liability for decisions made in reliance on the Outputs.

8. Third-party sources and links

The Service may reference third-party platforms, datasets or media. Those third parties are not under our control, and their inclusion does not constitute an endorsement. Third-party trademarks belong to their respective owners. If you leave the Service via an external link, you are responsible for reviewing the destination’s terms and privacy notices.

9. Limitation of liability

To the fullest extent permitted by law, we and our collaborators will not be liable for any indirect, incidental, consequential, special, exemplary or punitive damages, or for loss of profits, goodwill, data or other intangible losses arising from your use of the Service. Should liability be found despite this limitation, our aggregate liability will not exceed fifty pounds sterling (£50).

10. Indemnification

You agree to indemnify, defend and hold harmless the Service operator and its contributors from any claim, liability, damages, losses and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms or your infringement of any intellectual-property or other rights of a third party.

11. Service availability and changes

We may modify, suspend or discontinue the Service, or any part of it, at any time without liability. We do not guarantee uninterrupted availability and may perform maintenance or updates without notice. Sections that by their nature should survive termination—such as intellectual property, disclaimers, limitation of liability and indemnity—will continue in effect after access ends.

12. Governing law and dispute resolution

These Terms are governed by the laws of England and Wales, excluding conflict-of-law principles. We encourage you to contact us first to resolve any concern. If a dispute remains unresolved after 30 days, the parties agree to attempt good-faith negotiation or, if mutually agreed, independent mediation before pursuing other remedies. Nothing in this section prevents either party from seeking injunctive relief in a competent court.

13. Changes to these terms

We may update these Terms periodically to reflect changes in the Service, legal requirements or best practices. When we do, we revise the “Last updated” date above. Your continued use after any update constitutes acceptance of the revised Terms.

14. Contact

Questions relating to these Terms may be sent to legal@urtheproduct.com. We aim to respond within three business days.
